1. Preliminary Declaration
Koen Rutten and Johan Stroobants are associated judicial officers in the judicial district of Leuven and have established their studies at Vital Decosterstraat 46/0201 in 3000 LEUVEN. They perform their duties in the private limited company JUNCTO (VAT BE 0778.819.433) under the name Juncto judicial officers.
Juncto judicial officers processes necessary personal data when performing the tasks assigned to it, and attaches great importance to the privacy and protection of the processed personal data.

- “Personal Data” : any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.
- “Data subject” : any identified or identifiable natural person whose personal data are processed.
- “Restriction of processing” : marking of stored personal data with the aim of limiting its processing in the future.
- “Controller” : the person who determines the purposes and means of the processing of personal data.
- “Privacy Law” : the Law of 30 July 2018 on the protection of natural persons with regard to the processing of personal data.
- “GDPR” : Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/ 46/EC (General Data Protection Regulation).

Hereinafter abbreviated together: Juncto judicial officers.
4. Why are personal data processed?
Juncto judicial officers are judicial officers and public officials who are required to perform tasks in the public interest, as well as tasks entrusted to their offices in the exercise of public authority.
The processing of personal data by Juncto judicial officers is therefore necessary:
- To comply with the legal obligation incumbent on it, and,
- To protect the vital interests of the data subject or of another natural person, and,
- For the performance of a task of general interest or of a task in the exercise of public authority vested in it.
The duties and powers of judicial officers are listed, inter alia, in Article 519 of the Judicial Code, which reads as follows:
Article 519 of the Judicial Code :
Ҥ 1. Judicial officers have tasks for which they alone are authorized and for which they have ministry duties.
These tasks are:
1° the drafting and serving of all writs and the enforcement of judicial decisions, as well as deeds or titles in enforceable form;
1° bis the recovery of undisputed monetary debts in accordance with Chapter Iquinquies of the first title of the fifth part;
2° making determinations, at the request of magistrates and at the request of private persons, with regard to purely material facts, without issuing any opinion as to the causes and consequences in fact or in law that could result therefrom, as well as the determinations which are part of the legal exercise of their office; these findings are authentic in terms of the material facts and data that the judicial officer can sense;
3° drawing up protests against a bill of exchange, promissory note and bank draft;
4° the judicial public sale of movable property and ships in the context of enforcement;
5° the amicable judicial sale of movable property, in accordance with Article 1526bis;
6° the voluntary public sales of movable property, which monopoly they share with the notaries;
7° taking cognizance of notices of opposition, order, seizure, delegation, transfer, collective debt settlement and protest, which monopoly they share with the persons referred to in Article 1391, § 1;
8° the filing, deletion and modification of the notices of opposition, order, seizure, delegation, transfer, collective debt settlement and protest in the tasks entrusted to them or in which they were appointed.
§ 2. Judicial officers have residual powers for which they have no monopoly and no ministry duty, including:
1° examine at the clerk's office the issues, copies and extracts of all procedural documents and submit the petitions that they may sign under the law, as well as deposit all other petitions at the clerk's office;
2° for true signature of copies and translations of documents in their possession;
3° draw up extracts from all deeds of their office;
4° act as sequester;
5° ensure the amicable collection of debts;
6° act as pledge redeemer;
7° acting as a business mediator or legal representative within the framework of the law of 31 January 2009 on the continuity of businesses;
8° exercise the judicial mandate of provisional administrator;
9° make estimates of furniture and movable property and provide assistance to bankruptcy receivers with regard to the inventory and realization of the bankruptcy estate;
10° acting as an amicable debt mediator and as a debt mediator in the context of the collective debt settlement;
11° act as a mediator in family matters and as a mediator in the context of alternative dispute resolution;
12° acting as trustee over unmanaged estates;
13° provide legal advice with regard to the rights, obligations and burdens arising from legal acts involving judicial officers;
14° carry out solvency investigations, draw up and deliver asset reports;
15° issue tax certificates with regard to irrecoverable debts;
16° supervising authorized lotteries and competitions.
§ 3. The judicial officer has a general obligation to provide information to the person who has requested him to perform his duties and to the debtor. For example, in the event of imminent insolvency of the debtor, he will inform the instructing creditor of this, so that he can correctly assess the desirability of having implementation measures taken, and he will inform the debtor about the possibilities offered by the collective debt settlement.
If necessary, the judicial officer informs anyone who has requested him to perform his duties about the obligations and charges as well as the costs arising from writs, execution of judicial decisions, deeds or titles.
§ 4. The judicial officers strive, as far as possible, for the amicable resolution of disputes, inter alia by pointing out to the litigant the possibility of mediation, conciliation and any other form of amicable resolution of disputes.”
In addition to the aforementioned duties and powers, Juncto judicial officers also process personal data for:
- Correct accounting.
- Preparing cost statements and invoices.
- The preparation of statistical data and reports regarding the services provided.
- Recruiting staff.
5. Which personal data are processed?
Juncto judicial officers mainly processes the following data.
5.1 Identification Data
Identification data that are necessary for the exercise of the duties and powers assigned to it by law (see point 4. Why are personal data processed?). The processed identification data are mainly the surname, first names, national register number, date and place of birth and place of residence or place of residence of the data subjects.
5.2 Contact Information
Contact details of all parties involved who receive a document or deed and/or who contact us. Juncto judicial officers does this primarily to organize the procedures as economically and cost-efficiently as possible for those involved, and to continuously optimize the service. These contact details mainly concern the telephone number, mobile number(s) and/or e-mail address(es) of the data subject.
5.3 Financial Data
Certain financial data of the data subjects when payments are made to the escrow account or office account. This mainly concerns the account number, the account owner and the amount of the deposit.
5.4 Solvency Data
Solvency data in order to make a better assessment of which is the most process-economical recovery procedure for the respective parties involved. This could include, for example, the type of home or the condition of the home.

6. How are the personal data obtained?
The ways in which Juncto judicial officers obtain personal data are discussed below. It concerns personal data:
6.1 Which are observed
Juncto judicial officers processes the observations made during on-site visits, for example at the place of residence or residence of the person concerned.

For the performance of the tasks and powers assigned to it, Juncto judicial officers have access to secure authentic sources of information, which are only accessible if the applicable legal conditions have been met and after an identity check, if necessary with eID.
These authentic sources of information include:
- The National Register of Natural Persons
The following sources are consulted via this National Register of Natural Persons:
- The population registers and the registers of foreigners that are kept and updated by the municipal authorities. These registers form the main source of the National Register of Natural Persons.
- The registers kept at the Belgian diplomatic and consular posts abroad. These registers contain the data of Belgian nationals who are not included in the population registers of a Belgian municipality because they reside abroad and who have decided to register as such at a diplomatic or consular post.
- The waiting registers concerning asylum seekers, for which the Immigration Office has a general power to update the information data. It should be noted that, in addition to the Immigration Office, certain information is communicated by other bodies involved in the reception procedure for asylum seekers: the Commissioner General for Refugees and State Lottery, the Federal Agency for the Reception of Asylum Seekers (abbreviated as FEDASIL) , the Council for Alien Litigation, the Council of State as well as the directors of the reception centers for refugees.
- The central file of notices of attachment, delegation, transfer, collective debt settlement and protest (CBB)
The CBB is a digital database in which the messages of seizure, delegation, transfer, collective debt settlement and protest are centralized.
- The Crossroads Bank for Social Security (KSZ)
To check whether the debtor has an employer, receives benefits, receives a pension …
To inspect (provided from 2022):
- The RAD register: this register contains persons who have a national register number, but whose file is no longer actively managed by a municipality or a diplomatic mission. This includes persons who have been deleted from the National Register, who have moved abroad without registering with a diplomatic post, persons from the register of non-residents, etc.
- The Bis register: this register contains persons who have a link with Belgium, but who do not have a national register number. This includes frontier workers, persons who own property in Belgium, persons with Belgian social security rights but who do not reside in Belgium…
- The Vehicle Registration Service (DIV)
Juncto judicial officers has full online and secure access to the register of the Vehicle Registration Service (DIV).
Every motor vehicle (and trailer of which the maximum permitted mass is more than 750 kg) must be registered in this register in advance in order to be able to drive on public roads.
- The Patrimonial Documentation
By means of a digital consultation of the land register, Juncto judicial officers can verify whether the person concerned has rights in immovable property such as a house, an apartment or agricultural land. If this proves to be the case, Juncto judicial officers will also receive a complete cadastral description of these immovable properties.
- The Central Contact Point (CAP)
In the context of a conservatory attachment among third parties, Juncto judicial officers can request data from the Central Contact Point (CAP) via the Attachment Judge and with the intervention of the National Chamber of Judicial Officers.
The Central Point of Contact (CAP) is a register that contains the bank account numbers and types of contracts held by natural and legal persons, whether resident in Belgium or not, with financial institutions in Belgium.
The result that the judicial officer can obtain is an overview of all Belgian bank account numbers of the person concerned, and of the banks where these Belgian bank account numbers are held.
- The Central Registry of Marriage Agreements
This register contains data concerning marriage agreements and their amendments. However, the register only contains metadata and not the deeds themselves.
6.5 Obtained from public sources
These public sources include:
- KBO Public Search
The official data of companies registered in the Crossroads Bank for Enterprises (such as companies and sole proprietorships) have been collected and can be freely consulted online via KBO Public Search.
Via this online search engine managed by the Federal Public Service Economy, SMEs, Self-employed and Energy, the data of both active and discontinued companies can be found. You can search by KBO number, by name, by activity, by date of admission and by address.
- The European Justice Portal
The “Find a company” tool on the European e-Justice Portal allows anyone to request and view free company data from the commercial registers of all EU countries as well as Iceland, Liechtenstein and Norway. In addition, the European e-Justice portal provides a direct link to the national commercial register of the countries that are not yet affiliated with the portal.
- Central Balance Sheet Office National Bank of Belgium
By order of the legislator, the Central Balance Sheet Office of the National Bank of Belgium collects all filed annual accounts of virtually all legal entities in Belgium.
These annual accounts can be consulted free of charge on the website of the Central Balance Sheet Office and provide useful solvency information.
- The Central Inheritance Register
This register contains data on various types of deeds. However, the register only contains metadata and not the deeds themselves.
It concerns the following types of documents:
- Deeds or certificates of succession.
- European succession certificates.
- Deeds containing the declaration of rejection of the estate.
- Deeds containing the statement whereby heirs indicate that they only assume this capacity under the privilege of inventory.
- Orders appointing a receiver over the unmanaged estate.
- Dispositions appointing an administrator of the estate accepted under privilege of inventory.
- The Belgian Official Gazette
The Belgian Official Gazette can be consulted free of charge at any time at www.staatsblad.be .
Via the Belgian Official Gazette, we obtain first-hand official information regarding:
- Provisional administrators of companies.
- Assistance and management and representation regarding persons declared incapacitated (such as the appointment of an administrator over the person and/or property of a person declared incompetent).
- Bankruptcy judgments and appointments of a receiver.
- Judgments on judicial reorganization proceedings.
- Jurisdiction.
- Legislative changes.
- …
- The Pand Register
The Pledge Register is a digital database in which a right of pledge or a retention of title can be registered. The registered rights of pledge and retention of title can be consulted by Juncto judicial officers.
6.6 Who Process the Systems
Juncto judicial officers registers certain financial data when payments are made to the escrow account or office account. This mainly concerns the account number, the account owner and the amount of the deposit.
7. What personal data is passed on, to whom and why?
Below is an overview of third parties to whom Juncto judicial officers can pass on personal data, which personal data are involved and why. However, Juncto judicial officers can under no circumstances be held liable for any direct or indirect damage that may result from incorrect or unlawful use of personal data by third parties.
7.1 Transfer to the client
Personal data (especially identification data) that must necessarily be included in deeds will be passed on to the client.
In addition, Juncto judicial officers has a general obligation to provide information (article 519 § 3 of the Judicial Code) towards those who have requested it to perform its duties and towards each person concerned. For example, Juncto judicial officers will inform the ordering creditor in the event of imminent insolvency of a debtor, so that the latter can correctly assess the desirability of having implementation measures taken. At the same time, Juncto judicial officers will inform the debtor concerned about the possibilities offered by a collective debt settlement.
7.2 Transfer to the lawyer
The personal data (especially identification data and supporting documents) that must necessarily be included in the deeds will also be passed on to the lawyer of the commissioning party in order to enable them to conduct the procedures.
7.3 Transmission to judicial officers
The powers of judicial officers are territorially limited by law.
For Juncto judicial officers, this means that its office can only be exercised within the boundaries of the judicial district of Leuven (= municipalities of Aarschot, Begijnendijk, Bekkevoort, Bertem, Bierbeek, Boortmeerbeek, Boutersem, Diest, Geetbets, Glabbeek, Haacht, Herent, Hoegaarden, Holsbeek , Huldenberg, Keerbergen, Kortenaken, Kortenberg, Landen, Leuven, Linter, Lubbeek, Oud-Heverlee, Rotselaar, Scherpenheuvel-Zichem, Tervuren, Tielt-Winge, Tienen, Tremelo and Zoutleeuw).
If the person concerned lives outside the judicial district of Leuven, Juncto judicial officers must therefore call on locally competent judicial officers. Juncto judicial officers will have to pass on personal data to these judicial officers so that they can properly fulfill their legal assignment.
7.4 Transfer to Government Authorities
In the exercise of the duties and powers imposed on it, Juncto judicial officers will necessarily transfer personal data to various government agencies.
For example, the clerk of the court must be in possession of the original summons to which an extract from the National Register of Natural Persons is attached. Another example is informing the police of the addresses that will be visited for seizure with the assistance of the police.
7.5 Transfer to other processors
Juncto judicial officers can call on processors for the processing of your personal data. Agreements with these processors are laid down in a processing agreement in accordance with the AVG. The data may only be used for the specific purpose described in this agreement. Consider, for example, a processing agreement with a locksmith or a translator.
7.6 Transfer to other responsible parties
Juncto judicial officers will only pass on your personal data to third parties if there is a legal basis that allows the exchange of that data. If necessary, an agreement is concluded with these third parties so that Juncto judicial officers can be sure that your personal data is and will remain safe.
7.7 Transfer in case of reorganization
In the event of a total or partial reorganization of the activities of Juncto judicial officers, whereby these activities are reorganised, transferred or discontinued, or where Juncto judicial officers becomes the subject of insolvency proceedings, your data may be transferred to new entities or third parties.
8. How long will the personal data be kept?
Juncto judicial officers does not store your personal data longer than is necessary to achieve the purpose for which it was collected.
In view of the legal obligations, Juncto judicial officers will, in principle, store your personal data for a maximum of 10 years after the task assigned to it has ended. Once the job is finished, the stored data is only accessible to a limited extent.
After the applicable retention periods have expired, the processed personal data will be deleted or made anonymous.
9. What are your rights and how can you exercise them?
If Juncto judicial officers has processed your personal data, you as a data subject have at least the following rights that you can exercise at any time.
9.1 What are your rights?
- Right of access
You have the right to obtain confirmation as to whether or not your personal data is being processed and, if that is the case, to obtain access to that personal data and the following information:
- The processing purposes.
- The categories of personal data concerned.
- The recipients or categories of recipients to whom the personal data has been or will be disclosed.
- The period for which the personal data is expected to be stored, or if that is not possible, the criteria for determining that period.
- Has the right to lodge a complaint with the supervisory authority.
- All available information about the source of the data.
- The existence of automated decision-making.
Juncto judicial officers will provide you with a copy of the personal data being processed. If you request additional copies, a reasonable fee based on administrative costs may be charged. When you submit your request electronically, and do not request any other arrangement, the information will be provided in a commonly used electronic format.
- Right to rectification (rectification)
You have the right to have the processed personal data rectified (improved) without delay if they are incomplete, outdated or incorrect.
However, this right is not possible for personal data obtained from authentic sources such as the National Register of Natural Persons. If you would like to obtain a rectification of personal data from authentic sources, you will be directed to the government authorities that manage these authentic sources.
- Right to data erasure
You have the right to obtain the erasure of your processed personal data without undue delay in the following cases:
- The processed personal data has been processed unlawfully.
- The processed personal data are no longer necessary for the purposes for which they were collected or otherwise processed.
- There is no legal basis for the processing.
- The processed personal data must be erased to comply with a legal obligation.
ATTENTION: the processed personal data cannot be erased if the processing is necessary:
- To comply with a legal processing obligation that rests on Juncto judicial officers.
- For the performance of a task of general interest or the exercise of the public authority granted to Juncto judicial officers.
- For the establishment, exercise or defense of a legal claim.
- Right to restriction of processing
You have the right to obtain the restriction of the processing of your personal data if one of the following applies:
- You dispute the accuracy of your personal data that has been processed. In that case, the processing will be limited for the period necessary to verify the accuracy of the processed personal data.
- The processing of your personal data is unlawful and you object to the erasure of the personal data. Instead, you request the restriction of its use.
- Juncto judicial officers no longer needs the personal data for processing purposes, but you need it for the establishment, exercise or substantiation of a legal claim.
- You have objected to the processing, but have not yet received a response.
ATTENTION: your request to restrict the processing of your personal data cannot be granted if such processing is necessary:
- For the substantiation of a legal claim.
- To protect the rights of another natural or legal person.
- For important reasons of general interest for the European Union or for a Member State.
- Right to object to the processing
You have the right at any time to object – for reasons related to your specific situation – to the processing of your personal data that is processed necessary for the performance of a task carried out in the public interest or for the performance of a task in the framework of the exercise of the public authority entrusted to Juncto judicial officers.
The processing of the personal data to which you object will cease unless:
- There are compelling legitimate grounds for the processing that outweigh your interests, rights and freedoms, or,
- The processing is related to the establishment, exercise or defense of legal claims.
- Right to portability
You have the right to transfer your personal data to another controller.
This right does not apply to the processing of your personal data that is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.
9.2 How can you exercise your rights?
If you wish to exercise the aforementioned rights:
- You can register in person during office hours at the counter at Vital Decosterstraat 46/0201 in 3000 LEUVEN.
The counter is freely accessible on all working days from 09:00 to 12:00 and in the afternoon by appointment.
If you present yourself at the counter, the authenticity of your identity will be checked on the basis of your proof of identity and your question will be answered immediately, if possible. If your question cannot be answered immediately, this will be done as soon as possible and at the latest within one month after your visit.
